Welcome to Peakslead!
Peaksleadís service (the ‘PeaksLead Service’) is located at peakslead.com, app.peakslead.com, events.peakslead.com and is operated by PeaksLead. and its subsidiaries (collectively, ‘Peakslead’). The Peakslead Service provides buyers with the ability to find high-quality, unique Leads.
Use of the Peakslead Service
Contract: When you use our Services you agree to ALL of these terms. You agree by using our services or joining our services, you are agreeing to enter into a legally binding contract with Peakslead. If you do not agree to this contract do not access or use or any of our services.
Services: This Contract applies to Peakslead.com, app.peakslead.com, events.peakslead.com, and other Peakslead services that state that they are offered under this Contract (ìServicesî). Registered users of our Services are ìUsersî and unregistered users are ìVisitorsî. This Contract applies to both.
We reserve the right to refuse to do business with any user attempting to use identity masking services.
Change: We may modify this Contract from time to time. If we make material changes to it, we will provide you notice through our Services, or by other means, to provide you the opportunity to review the changes before they become effective. Your continued use of our Services after we publish or send a notice about our changes to these terms means that you are consenting to the updated terms.
Member Account, Password, and Security: You are responsible for maintaining the confidentiality of your password and account, if any, and are fully responsible for any and all activities that occur under your password or account. Please immediately notify Peakslead of any unauthorized use of your password or account or any other breach of security. Peakslead reserves the right to terminate accounts and/or campaigns that are inactive for six (6) months or more.
Multiple Member Accounts Prohibited: Operating and maintaining multiple member accounts is prohibited. If you have a legitimate business need for a second account, you can apply for an exception to this policy by following the process outlined in Peaksleadís My Account.
Misuse of Member Account: If you repeatedly buy excessive amounts of Leads, engage in fraud or other illegal activity, fail to comply with the Terms of Service or any other Peakslead policies, or otherwise use the service in an excessive or unreasonable way, Peakslead may, in its sole discretion, cancel your campaigns, suspend your use of Peakslead tools and reports, restrict or terminate your account, and/or withhold and disburse any proceeds associated with that account.
Please remember that Peakslead has no control over the way Social Networking Services use, store and disclose your information. Please review their policies to understand their privacy-related practices. Peakslead also has no control over the content made available through any Social Networking Service. Please review their policies to understand their content-related practices. Peakslead does not have any liability or responsibility for the acts or omissions of any of the Social Networking Services accessed through the Peakslead Service. Peakslead enables these features merely as a convenience and the integration or inclusion of such features does not imply an endorsement or recommendation.
Promotions: Any contests, sweepstakes, surveys or similar promotions (collectively, ìPromotionsî) made available through the Peakslead Service may be governed by specific rules that are in addition to these Terms of Service. By participating in any Promotion, you will become subject to those rules. To the extent that the terms and conditions of the Promotion rules conflict with these Terms of Service, the terms and conditions of the Promotion will control.
Age Requirement: If you are under 18 years of age, you are not authorized to use the Service.
Applicable Laws: In connection with your use of the Peakslead Service, you will comply with all applicable laws, regulations and industry standards.
General Practices and Instructions Regarding Use: You will comply with any instructions provided to you by Peakslead in connection with your use of the Peakslead Service. Peakslead may establish general practices and limits concerning use of the Peakslead Service. Peakslead reserves the right to change its instructions, general practices, and limits at any time, in its sole discretion, with or without notice.
Payment: If you purchase any leads through the Peakslead Service, you will be required to provide Peakslead information regarding your credit card or another payment instrument. You represent and warrant to Peakslead that such information is true and that you are authorized to use the payment instrument. You will be responsible for all taxes associated with your purchase of leads through the Service.
Cancellation: We reserve the right to cancel any order for any leads for any reason.
Refund: You acknowledge and agree that our products and servicesówhich are digitally delivered and non-tangible goodsówe cannot offer refunds or chargebacks for purchases. You have no right to cancel any order or return any Leads and all orders are final.
Waiver: Your purchase of an item using the Peakslead Service constitutes a waiver of any and all intellectual property, proprietary, personal, and privacy claims relating to that purchase.
Monthly Perpetual Subscriptions: You won’t be billed until after your 50 credits trial expires. You can change plans or cancel your account at any time.
All subscriptions purchased through the Peakslead website are monthly perpetual beyond their minimum required time & must be terminated by the customer. After the first payment is made, activation to the service/site occurs. These subscriptions will be charged up front or monthly depending on the arrangement.
These subscriptions will be renewed monthly or yearly depending on the arrangement.
Renewal Policy: Subscriptions purchased through the Peakslead website will automatically renew thirty days from the date of purchase at the then current price for the number of users the Client has registered. Payment will be billed to the credit card or banking information on file, or Client will be invoiced, as applicable.
Cancellation Policy: Subscription to the Service may be terminated at any time, and without cause, by Peakslead, the site or the client upon notification of the other by electronic or conventional mail, or by telephone. When the client requests termination, subscription fees are NOT refunded. The client is liable for charges incurred by them until termination of service. The client can send a written notice to Peakslead, either through e-mail to firstname.lastname@example.org
Peakslead’s Proprietary Rights
Service Content, Software, and Trademarks: You are only authorized to use the Peakslead Service for the purpose of engaging in business transactions with Peakslead. You may not use any automated technology to scrape, mine or gather any information from the Peakslead Service or otherwise access the pages of the Peakslead Service for any unauthorized purpose. If you are blocked by Peakslead from accessing the Peakslead Service (including by blocking your IP address), you agree not to implement any measures to circumvent such blocking (e.g., by masking your IP address or using a proxy IP address). The technology and software underlying the Peakslead Service or distributed in connection therewith are the property of Peakslead, our affiliates and our partners (the ìSoftwareî). You agree not to copy, modify, create a derivative work of, reverse engineer, reverse assemble or otherwise attempt to discover any source code, sell, assign, sublicense, or otherwise transfer any right in the Software.
The Peakslead Service may contain images, artwork, fonts and other content or features (ìService Contentî) that are protected by intellectual property rights and laws. Except as expressly authorized by Peakslead, you agree not to modify, copy, frame, rent, lease, loan, sell, distribute or create derivative works based on the Peakslead Service or the Service Content, in whole or in part. Any use of the Peakslead Service or the Service Content other than as specifically authorized herein is strictly prohibited. Any rights not expressly granted herein are reserved by Peakslead.
The Peakslead name and logos are trademarks and service marks of Peakslead (collectively the ìPeakslead Trademarksî). Nothing in these Terms of Service or the Peakslead Service should be construed as granting any license or right to use any of Peakslead Trademarks displayed on the Peakslead Service, without our prior written permission in each instance. All goodwill generated from the use of Peakslead Trademarks will inure to Peaksleadís exclusive benefit.
You may not develop or derive for commercial sale any data in any form that incorporates or uses any of the Information. Except with the prior written consent of Peakslead, you may not transfer or disclose any Information to anyone else. You may only use the Site for commercial purposes after registering and paying any applicable fees for one or more applicable Peakslead Services. You may use the Services solely for personal and/or your internal business purposes only, subject to the limitations set forth herein.
Third Party Websites
The Peakslead Service may provide, or third parties may provide, links or other access to other sites and resources on the Internet. Peakslead has no control over such sites and resources and Peakslead is not responsible for and does not endorse such sites and resources. Peakslead will not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any content, events, goods or services available on or through any such site or resource. Any dealings you have with third parties found while using the Peakslead Service are between you and the third party, and you agree that Peakslead is not liable for any loss or claim that you may have against any such third party.
Disclaimer of Warranties
YOUR USE OF THE PEAKSLEAD SERVICE IS AT YOUR SOLE RISK. THE PEAKSLEAD SERVICE IS PROVIDED ON AN ìAS ISî AND ìAS AVAILABLEî BASIS. WITHOUT LIMITING A BUYERíS RIGHT TO RETURN DATA AND OBTAIN A REFUND TO THE EXTENT DESCRIBED IN OUR RETURN POLICY, PEAKSLEAD EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND WITH RESPECT TO ANY DATA OR SERVICE, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING THE IMPLIED WARRANTIES OF DATA.
Limitation of Liability
YOU EXPRESSLY UNDERSTAND AND AGREE THAT WITH REGARD TO THE CONTENT, PRODUCTS AND SERVICES AVAILABLE THROUGH THIS SITE, IN NO EVENT SHALL PEAKSLEAD OR ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUCCESSORS, SUBSIDIARIES, AFFILIATES, DISTRIBUTORS OR THIRD PARTIES PROVIDING INFORMATION ON THIS SITE BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF PEAKSLEAD HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES). Peakslead, in its sole discretion, may suspend or terminate your account (or any part thereof) or use of the Peakslead Service and remove and discard any content within the Peakslead Service, for any reason. Further, you agree that Peakslead will not be liable to you or any third party for any termination of your access to the Peakslead Service.
Each party is an independent contractor in the performance of each and every part of these Terms of Service. Each party will be solely responsible for all of its employees and agents and its labor costs and expenses and for any and all claims, liabilities or damages or debts of any type whatsoever that may arise on account of its activities, or those of its employees or agents, in the performance of its activities under these Terms of Service. You do not have the authority to commit Peakslead in any way and will not attempt to do so or imply that you have the right to do so.
For users located in the European Union: These Terms of Service will be governed by the laws of the United Kingdom, without regard to its conflict of law provisions. With respect to any disputes, you and Peakslead agree to submit to the personal and exclusive jurisdiction of the courts located in London, England. The parties expressly exclude the application of the UN Convention on Contracts for the International Sale of Goods.
For all other users: These Terms of Service will be governed by the laws of the State of Bucharest without regard to its conflict of law provisions. With respect to any disputes, you and Peakslead agree to submit to the personal and exclusive jurisdiction of the state and federal courts located within Bucuresti County, Bucharest. The parties expressly exclude the application of the UN Convention on Contracts for the International Sale of Goods.
These Terms of Service constitute the entire agreement between you and Peakslead and govern your use of the Peakslead Service, superseding any prior agreements between you and Peakslead with respect to the Peakslead Service. The failure of Peakslead to exercise or enforce any right or provision of these Terms of Service will not constitute a waiver of such right or provision. If any provision of these Terms of Service is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the partiesí intentions as reflected in the provision, and the other provisions of these Terms of Service remain in full force and effect. A printed version of this agreement and of any notice given in electronic form will be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. You may not assign these Terms of Service without the prior written consent of Peakslead, but Peakslead may assign or transfer these Terms of Service, in whole or in part, without restriction. Notices to you may be made via either email or regular mail. Peakslead may also provide notices to you of changes to these Terms of Service or other matters by displaying notices or links to notices generally on the Peakslead Service.

Information We Collect
Information You Provide to Us. ‘Personal Information’ means information that alone or in combination with other information may be used to readily identify, contact, or locate you. The Personal Information we collect will be different depending on your activities on the Peakslead Service. For example, to register on our service, we will collect your name and email address. If you register using a sign-in service or a social media platform such as Facebook, we will collect the information needed to authenticate your account and any other information the platform provides in that process. If you make a purchase through the Peakslead Service, we will collect your name, email address, shipping address and payment information such as credit card number and billing address.
Peakslead Tools. ‘Performance Information’ means the information we collect through certain tools that we provide to our sellers. Where a seller requests the use of a particular tool (e.g. an advertising analytics tool for use with ad platforms), then Peakslead will collect additional data based on the operation of that tool (e.g. advertising conversion information from the applicable ad platform).
Blog. The Peakslead Service may offer publicly accessible blogs or community forums. You should be aware that any information you provide in these areas may be read, collected, and used by others who access them. To request removal of your personal information from our blog or community forum, contact us here. In some cases, we may not be able to remove your Personal Information, in which case we will let you know if we are unable to do so and why.
Single Sign-On. You can log into the Peakslead Service using sign-in services such as Facebook Connect or an Open ID provider. These services will authenticate your identity and provide you the option to share certain Personal Information with us such as your name and email address to pre-populate our sign up form. Services like Facebook Connect give you the option to post information about your activities on the Peakslead Service to your profile page to share with others within your network.
How We Use Your Information
In general, we use Personal Information to provide the Peakslead Service to you, including, to establish and administer your account, to fulfill your order and send you an order confirmation and to respond to customer service requests.
If you wish to subscribe to our newsletter(s), we will use your name and email address to send the newsletter to you. You may choose to stop receiving our newsletter or marketing emails by following the unsubscribe instructions included in these emails, accessing the email preferences in your account settings page or you can contact us here. You may not opt-out of the transactional emails Peakslead sends in connection with your use of the Peakslead Service (e.g. email notification of individual account activity, such as the shipment of an order, or broader account notifications such as changes to Peaksleadís policies).
We partner with a third party to either display advertising on our website or to manage our advertising on other sites. Our third party partner may use technologies such as cookies to gather information about your activities on this website and other sites in order to provide you advertising based upon your browsing activities and interests. If you wish to not have this information used for the purpose of serving you interest-based ads, you may opt-out by clicking here.
We use Performance Information to analyze and better understand the characteristics of successful offerings and campaigns and to improve the performance of our sellers and the overall Peakslead Service.
Peakslead does not collect Personal Information about your online activities over time, across different web sites. Accordingly, Peakslead does not currently respond to ìdo, not trackî browser requests.
We will share information we collect, including your Personal Information, as needed to provide the Peasklead Service to you. We will also share your Personal Information with your permission. Otherwise, we do not rent, sell or share your Personal Information with third parties and specifically will not share your Personal Information for their direct marketing purposes without your consent.
Strategic Partners. We may share aggregated, anonymized data with certain marketing and content licensing partners. Where a partner or agency compensates buyers directly, we will also share performance data with the partner to enable those payments.
Vendors and Service Providers. To provide you with the Peakslead Service, we share information, including Personal Information, with third-party service providers. For example, we provide Personal Information to companies that help us with our business activities, such as marketing, payment processing, and fulfillment. We will use reasonable efforts to ensure those companies use your Personal Information only as necessary.
As Required by Law and Similar Disclosures. In certain situations, Peakslead may be required to disclose personal data in response to lawful requests by public authorities, including meeting law enforcement requirements. We may access, preserve, and disclose your Personal Information and content if we believe doing so is required or appropriate to comply with law enforcement requests, such as a court order or subpoena, bankruptcy proceedings, or similar legal process or when we believe in good faith that disclosure is necessary to protect our rights or the rights of others. Specifically, we may disclose your information to a complainant who alleges that your activities have violated their rights or policies (e.g. where your campaign or advertisement is the subject of an investigation). We may also disclose your information where you have alleged violation of your rights by another party.
Merger, Sale or Other Asset Transfers. If Peakslead is involved in a merger, acquisition, or sale of all or a portion of its assets, you will be notified via email and/or a prominent notice on our website, of any change in ownership, uses of your personal information, and choices you may have regarding your personal information.
We may also disclose your personal information to any other third party with your prior consent.
Manage Your Information
Upon request, Peakslead will provide you with information about whether we hold any of your personal information. If you would like to update or modify any Personal Information you have provided to us, you can do so in the account settings tab of your dashboard or by contacting us. For your protection, we will require some proof of your identity to obtain any Personal Information hosted on our site. Additionally, you may deactivate your account by contacting us. At your request, we will remove your Personal Information, provided we have no outstanding business or other obligation requiring such information. We will respond to your request within a reasonable time-frame.
We do not knowingly collect, maintain, or use Personal Information from children under 18 years of age without parental consent, and no part of the Peakslead Service is directed to children under the age of 18. If you learn that your child has provided us with Personal Information without your consent, you may alert us here.
We will retain your information for as long as your account is active or as needed to provide you services. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.
The security of your Personal Information is important to us and we take reasonable steps to ensure that it is treated accordingly. However, we cannot ensure the security of any information provided to us. We do not accept liability for unintentional disclosure.
You agree that we may communicate with you electronically regarding security, privacy, and administrative issues relating to your use of the Peakslead Service. If we learn of a security system breach, we may attempt to notify you electronically by posting a notice on the Peakslead Service or by sending an email to you. You may have a legal right to receive this notice in writing. To receive free written notice of a security breach (ie, to withdraw your consent from receiving electronic notice), please notify us here. When you enter sensitive information (such as a credit card number) on our order forms, we encrypt the transmission of that information using secure socket layer technology (SSL).

What You Can Expect From Us. We will always comply with the standards, procedures, and requirements of EU data protection laws to ensure that the personal information you give us is kept appropriately secure and processed fairly and lawfully. We offer a variety of payment methods through the familiar and trusted PayPal interface. We process MasterCard and Visa credit cards, Masterpass, credit facility, and direct bank transfer payment method.
