PeaksLead respects your privacy and your rights to control your Personal Data. This statement will let you know what personal data PeaksLead processes, how we use personal data, and the rights you have to control and protect your personal data. Information We Collect

Information You Provide to Us. ìPersonal Informationî means information that alone or in combination with other information may be used to readily identify, contact, or locate you. The Personal Information we collect will be different depending on your activities on the Peakslead Service. For example, to register on our service, we will collect your name and email address. If you register using a sign-in service or a social media platform such as Facebook, we will collect the information needed to authenticate your account and any other information the platform provides in that process. If you make a purchase through the Peakslead Service, we will collect your name, email address, shipping address, and payment information such as credit card number and billing address.

Automated Technologies. ìSite Informationî means information received and recorded on our server logs from your browser, including your IP address, browser type, the date and time of the use, the pages you visit, the page you came from and go to when leaving the Peakslead Service, your operating system and information about your mobile device. We may combine this automatically collected log information with other information we collect about you. In addition, we also automatically collect Site Information when you access or use the Peakslead Service. We collect that information using cookies, pixel tags, web beacons, embedded web links, and similar technologies. Users can control the use of cookies at the individual browser level. If you reject cookies, you may still use our site, but your ability to use some features or areas of our service may be limited.

We Peakslead and our partners use technologies such as cookies or similar technologies to analyze trends, administer the website, track usersí movements around the website, and to gather demographic information about our user base as a whole. We also use cookies for our shopping cart, to remember usersí settings (e.g. language preference), for authentication and other similar services. Users can control the use of cookies at the individual browser level. If you reject cookies, you may still use our site, but your ability to use some features or areas of our service may be limited.

Peakslead Tools. ìPerformance Informationî means the information we collect through certain tools that we provide to our sellers. Where a seller requests the use of a particular tool (e.g. an advertising analytics tool for use with ad platforms), then Peakslead will collect additional data based on the operation of that tool (e.g. advertising conversion information from the applicable ad platform).

Blog. The Peakslead Service may offer publicly accessible blogs or community forums. You should be aware that any information you provide in these areas may be read, collected, and used by others who access them. To request removal of your personal information from our blog or community forum, contact us here. In some cases, we may not be able to remove your Personal Information, in which case we will let you know if we are unable to do so and why.

Social Media Widgets. The Peakslead Service may include social media features, such as the Facebook like button and share buttons. These features may collect your IP address, which page you are visiting on our site, and may set a cookie to enable the features to function properly. Certain social media features are hosted by the applicable provider (e.g. Facebook). Your interactions with these features are governed by the privacy policy of the company providing the features.

Single Sign-On. You can log into the Peakslead Service using sign-in services such as Facebook Connect or an Open ID provider. These services will authenticate your identity and provide you the option to share certain Personal Information with us such as your name and email address to pre-populate our sign up form. Services like Facebook Connect give you the option to post information about your activities on the Peakslead Service to your profile page to share with others within your network.

How We Use Your Information

In general, we use Personal Information to provide the Peakslead Service to you, including, to establish and administer your account, to fulfill your order, and send you an order confirmation and to respond to customer service requests.

If you wish to subscribe to our newsletter(s), we will use your name and email address to send the newsletter to you. You may choose to stop receiving our newsletter or marketing emails by following the unsubscribe instructions included in these emails, accessing the email preferences in your account settings page or you can contact us here. You may not opt-out of the transactional emails Peakslead sends in connection with your use of the Peakslead Service (e.g. email notification of individual account activity, such as the shipment of an order, or broader account notifications such as changes to Peaksleadís policies).

We partner with a third party to either display advertising on our website or to manage our advertising on other sites. Our third party partner may use technologies such as cookies to gather information about your activities on this website and other sites in order to provide you advertising based upon your browsing activities and interests. If you wish to not have this information used for the purpose of serving you interest-based ads, you may opt-out by clicking here.

We use Performance Information to analyze and better understand the characteristics of successful offerings and campaigns and to improve the performance of our sellers and the overall Peakslead Service.

Peakslead does not collect Personal Information about your online activities over time, across different web sites. Accordingly, Peakslead does not currently respond to ìdo, not trackî browser requests.

Peakslead processes Personal Information in the European State. Please note that you are agreeing to the transfer of your Personal Information to other locations throughout the world. Your Personal Information will be processed in accordance with this Privacy Policy. Peakslead, Inc. participates in the Safe Harbor program maintained by the European Union and has certified that it adheres to the programís privacy principles. Manage Your Information

Upon request, PeaksLead will provide you with information about whether we hold any of your personal information. If you would like to update or modify any Personal Information you have provided to us, you can do so in the Privacy Center of your dashboard or by contacting us. For your protection, we will require some proof of your identity to obtain any Personal Information hosted on our site. Additionally, you may deactivate your account by contacting us. At your request, we will remove your Personal Information, provided we have no outstanding business or other obligation requiring such information. We will respond to your request within a reasonable time-frame.

What does PeaksLead do with the data?

Compilation & Verification: Once collected PeaksLead periodically tests the data it has to ensure high levels of accuracy and validity. Using trusted partners PeaksLead updates and validates firmographic and technographic information and it combines this with the tested data to form a complete record of Business Data.

Storage & Security: PeaksLead stores Business Data in its cloud platform and all personal data is AES-256 encrypted at rest including the underlying storage, automated back-ups, logs, read replicas, and snapshots. PeaksLead does not then do anything else with the Business Data it holds other than make it available to its Customers. Where data is transferred to customers outside of the European Economic Area (EEA) we will take reasonable steps to ensure any personal data is treated securely and in accordance with applicable data protection laws.

Access: As a PeaksLead customer you will need to choose and keep safe a password in order to use the platform. Please do not share your password with anyone.

Retention: It is mission-critical for our business to be able to provide customers with accurate data. Therefore, we will retain your personal information for as long as it remains accurate and up to date (as best we can tell it is accurate) and we will remove your data if we confirm that it is no longer accurate or you have requested to restrict us from processing your data.

Use of the data: We use your information for several purposes, such as:

  • Providing our customers with access to a database of accurate Business Data Records designed to enable them to promote their goods and services using direct marketing to the right people (decision-makers, influencers, champions, etc.) in other businesses;
  • Promoting your business so it can be found when searched for;
  • Helping us keep you up to date about changes to the platform, its content, our services, changes in policies and other important notifications;
  • Enabling you to interact with features or tools on our platform such as our live chat function;
  • Providing you with the services we have and offering new services;
  • Improving your user experience;
  • Gathering analytics on usage and other statistics in order to improve features and functionality.

Security

The security of your Personal Information is important to us and we take reasonable steps to ensure that it is treated accordingly. However, we cannot ensure the security of any information provided to us. We do not accept liability for unintentional disclosure.

You agree that we may communicate with you electronically regarding security, privacy, and administrative issues relating to your use of the Peakslead Service. If we learn of a security system breach, we may attempt to notify you electronically by posting a notice on the Peakslead Service or by sending an email to you. You may have a legal right to receive this notice in writing. To receive free written notice of a security breach (ie, to withdraw your consent from receiving electronic notice), please notify us here. When you enter sensitive information (such as a credit card number) on our order forms, we encrypt the transmission of that information using secure socket layer technology (SSL).

General Data Protection Regulation

This privacy policy applies specifically to all buyers from whom we collect and process data with the European Union and who are European Citizens. We take your privacy very seriously. We work hard to make sure that we only use your information in the ways that you want us to.

Your Legal Rights. Under certain circumstances, you have rights under data protection laws in relation to your personal data. These include:

Rectification: You may request that we correct any inaccuracies in the personal data that we hold on you.

Be Forgotten: In certain circumstances, you may have the right to be forgotten (which means we have to erase all of your personally identifiable data). To ensure we are able to restrict all future processing of your data we recommend you request to opt-out of PeaksLead which will enable us to suppress you from future communications, rather than delete your data. Restriction: In some cases, you may ask for the processing of your personal data to be restricted because there is some disagreement about its accuracy or legitimate usage – i.e. requesting that we do not process your personal data for direct marketing purposes by keeping a single record of your data on a suppression list. Object: to state that you object to our processing of your personal data if we are relying on legitimate interest as the lawful ground for the processing.

Portability: You may request to have your personal data transferred from us to a different organization.

PeaksLead relies on the legitimate interest precedent as an appropriate legal basis under the applicable Data Protection Laws to provide Business Data to its customers.

Customers may use the Business Data for the sending of direct business to business marketing communications provided they do so in accordance with the applicable laws. In this respect, where employees of a public or corporate entity are contacted for the purposes of direct marketing, the initiator may conduct such marketing activity under an unsubscribe / opt-out basis.

Anti-Spam Policy

GDPR, CASL, and CAN-SPAM share core provisions to deal with spam and malicious messages. That includes measures to…

  • Define impermissible electronic communications like spam
  • Set standards on permissible communications, including:
    • Limits on who you can send messages to
    • Requirements for senders to clearly identify themselves
    • Requirements for clear unsubscribe, opt-out and or opt-in mechanisms
  • Set rules for acquiring and documenting recipient consent (opt-in vs opt-out)
  • Specify penalties for infraction including fines and private right of action (PRA)

Do you use email in your business? The CAN-SPAM Act, a law that sets the rules for commercial email, establishes requirements for commercial messages, gives recipients the right to have you stop emailing them, and spells out tough penalties for violations.

Despite its name, the CAN-SPAM Act doesn’t apply just to bulk email. It covers all commercial messages, which the law defines as “any electronic mail message the primary purpose of which is the commercial advertisement or promotion of a commercial product or service,” including email that promotes content on commercial websites. The law makes no exception for business-to-business email. That means all email – for example, a message to former customers announcing a new product line – must comply with the law.

Each separate email in violation of the CAN-SPAM Act is subject to penalties of up to $41,484, so non-compliance can be costly. But following the law isn’t complicated. Here’s a rundown of CAN-SPAM’s main requirements:

  1. Don’t use false or misleading header information: Your “From,” “To,” “Reply-To,” and routing information – including the originating domain name and email address – must be accurate and identify the person or business who initiated the message.
  2. Don’t use deceptive subject lines: The subject line must accurately reflect the content of the message.
  3. Identify the message as an ad: The law gives you a lot of leeway in how to do this, but you must disclose clearly and conspicuously that your message is an advertisement.
  4. Tell recipients where you’re located: Your message must include your valid physical postal address. This can be your current street address, a post office box you’ve registered with the U.S. Postal Service, or a private mailbox you’ve registered with a commercial mail receiving agency established under Postal Service regulations.
  5. Tell recipients how to opt-out of receiving future emails from you: Your message must include a clear and conspicuous explanation of how the recipient can opt-out of getting an email from you in the future. Craft the notice in a way that’s easy for an ordinary person to recognize, read, and understand. Creative use of type size, color, and location can improve clarity. Give a return email address or another easy Internet-based way to allow people to communicate their choice to you. You may create a menu to allow a recipient to opt-out of certain types of messages, but you must include the option to stop all commercial messages from you. Make sure your spam filter doesn’t block these opt-out requests.
  6. Honor opt-out requests promptly: Any opt-out mechanism you offer must be able to process opt-out requests for at least 30 days after you send your message. You must honor a recipient’s opt-out request within 10 business days. You can’t charge a fee, require the recipient to give you any personally identifying information beyond an email address, or make the recipient take any step other than sending a reply email or visiting a single page on an Internet website as a condition for honoring an opt-out request. Once people have told you they don’t want to receive more messages from you, you can’t sell or transfer their email addresses, even in the form of a mailing list. The only exception is that you may transfer the addresses to a company you’ve hired to help you comply with the CAN-SPAM Act.
  7. Monitor what others are doing on your behalf: The law makes clear that even if you hire another company to handle your email marketing, you can’t contract away your legal responsibility to comply with the law. Both the company whose product is promoted in the message and the company that actually sends the message may be held legally responsible.
